Revisions to the Families First Corona Response Act (FFCRA) narrow the scope of exempt employees. FFCRA implemented mandatory FMLA and paid time off requirements for employers with fewer than 500 employees and for health care workers. The rule was previously interpreted to include all employees employed by an organization providing health care services to be included in the definition of health care workers. The revised rule limits the definition of health care workers to those directly integrated into patient care and services. The rule is set to expire Dec. 31. The proposed rule goes into effect Sept. 16 and is not retroactive.
