The Associate In-House Counsel is responsible for providing legal advice, legal guidance, and legal representation to Presbyterian Senior Living's Communities and its corporate accounting/finance department with regard to various legal issues related to accounting and finance, collections, Medicaid eligibility and appeals, guardianships, estates, admission agreements, and vendor agreements. The Associate In-House Counsel is also responsible for the direct supervision and management of the collections function and team members, as well as supporting Presbyterian Senior Living's Vice President of Legal, In-House Counsel.

Responsibilities and Expectations:

  • Responsible for attending and representing Presbyterian Senior Living in court proceedings, including but not limited to Medicaid eligibility hearings, guardianship hearings, estate hearings, breach of contract hearings and any other legal matters as may be appropriate
  • Responsible for overseeing legal issues related to Independent Living Residence and Care Agreements, Personal Care Admission Agreements, Health Center Admission Agreements, Mortgages/Notes and other Agreements
  • Responsible for assisting with research related to accounting-related industry regulations; and compliance and due diligence related to acquisitions, affiliations, and divestitures
  • Responsible for identifying finance and collection-related legal issues
  • Responsible for ensuring compliance with applicable laws and regulations related to finance and collection efforts
  • Responsible for oversight and effectiveness of the collections department
  • Responsible for the direct oversight of outside/third party legal counsel with regarding to financial and collection issues
  • Responsible for managing relationships with external law firms, ensuring cost-effective legal and financial services when needed
  • Responsible for managing and overseeing Presbyterian Senior Living's vendor contracting function
  • Responsible for providing education and guidance to Presbyterian Senior Living staff in regard to applicable laws and regulations related to finance and collection efforts
  • Responsible for managing and overseeing Presbyterian Senior Living's subsidized/charitable care process
  • Responsible for oversight of and drafting/revising Presbyterian Senior Living's policies and/or procedures related to subsidized care and collection efforts
  • Responsible for providing education and guidance to Presbyterian Senior Living team members
  • Responsible for reviewing, overseeing, supporting, evaluating and implementing technology solutions as they related to collections responsibilities and deliverables

Qualifications

  • Bachelor’s Degree and Juris doctor degree from an accredited law school required
  • Admission to Pennsylvania State Bar in good standing required
  • Admission to Maryland and Delaware State Bar in good standing preferred
  • Experience with collection-related law required
  • Experience with nursing home billing, collections and Pennsylvania Medicaid eligibility issues required
